#ELB: BREAKING: Divided Three Judge Court Holds North Carolina Congressional Redistricting an Unconstitutional Partisan Gerrymander, Considers New Districts for 2018 Elections https://electionlawblog.org/?p=100857

Not only is the timing frustrating to me, but the idea that a partisan gerrymander is unconstitutional is a bit nuts. This is the judicial branch sticking their noses into what is obviously a political question. Racial gerrymanders are one thing, but partisan is kind of the point
-
What? Partisan gerrymandering directly subverts the point of having elections in the first place. Voters should choose their officials, not the other way round.
-
Absolutely! Gerrymandering should be illegal. Make fair voting maps. I'm hesitant to get my hopes up that this will happen, but this would be amazing!

If the Court is unable to issue a stay because of a 4-4 split, would this not invigorate GOP efforts in the Senate to push Kavanaugh's nomination through?

Pretty cool how Judge Wynn looks to three constitutional sources for partisan gerrymanders — and both conservative and liberal precedents to get there. Neil Gorsuch would hate it.
