Would this apply to violations that occurred before they relaxed their standards?

These are just the internal standards that prosecutors use and are not e.g. regulations, so I'd be surprised if they applied to only new acts. But I haven't looked at whether the USAM says anything on that point.

This is why many lawyers I spoke with last night expressed surprise about the Cohen plea. It seems like it would have been onerous to prove “knowingly and willfully” to a jury. But who knows what the evidence is.
