Hey @patrickdmarley do we know for sure the new judge on the panel was assigned randomly, as article says? Usually Chief Judge assigns members of three-Judge panelshttps://twitter.com/BradyCarlson/status/1025387152358735872 …

Wisconsin's redistricting case is back before a three-judge panel - but @patrickdmarley reports the membership of that panel is different. https://www.jsonline.com/story/news/politics/2018/08/02/wisconsins-redistricting-case-draws-new-judge-panel/892642002/ …

I called Peterson’s office and was told he was randomly assigned. (And there is no order from the 7th Circuit in the PACER docket on the natter.)

I bet it is not so, but Peterson's office may not know.

I’ll double check with the 7th Circuit. The chief judge did appoint the initial panel.

The short answer: Peterson was randomly assigned, according to Collins Fitzpatrick, the administrator for the 7th Circuit. (1/)

The long answer (per Fitzpatrick): When the case was originally filed, it was randomly assigned — as all cases are — and went to Crabb. (2/)

The statute requires that a 3-judge panel hear redistricting cases. 7th Circuit Chief Judge Diane Wood filled out the panel with Ripple and Griesbach. (3/)

When Crabb withdrew from the case this week, it went back to a random assignment for her spot on the panel, according to Fitzpatrick. (4/)

Peterson was the one who was randomly chosen. (5/end)

Also worth noting — there are just two full-time judges in Wisconsin’s western district, so it was a 50/50 chance it would go to Peterson. The other judge is William Conley.
