Deregulation in itself is not a bad thing depending on the specific issue. We have all benefited from Jimmy Carter deregulating airlines.

If you're assessing a judicial nominee based on his or her views on various issues, then you're right. But if you're considering their willingness to apply legal principles in a fair, neutral, unbiased manner regardless of political consequences, this example's very probative.
