RIP my mentions for this thread Man, I did not realize how deep the conspiracy theories on the left go, matching what we saw on the right in the run-up to 2016https://twitter.com/rickhasen/status/1012684820067962881 …

This tweet intimates that Justice Kennedy voted corruptly in cases because of his son’s work w Trump. That’s a very serious charge without evidence. Now the @adamliptak @maggieNYT “buttering up guy w huge ego to get him to leave” theory much more plausible. https://twitter.com/neeratanden/status/1012665534297624577 …

It wouldn’t have been a big deal if Trump didn’t act chummy mentioning the kids with Kennedy at SOTU address. Any other president would have taken pains to separate himself from a look of impropriety. Trump is the definition of impropriety.

So Rick, I’m just catching up here and looking for truth. This whole thing about Kennedy‘s son bankrolling Trump is untrue? Thanks for any objectivity you can give. A dem looking for truth.

I think the key takeaway here is that presidents and Supreme Court justices have had far closer relationships than Trump has with Kennedy. LBJ with Abe Fortas is the most extreme example I know. Nothing in the Trump-Kennedy relationship forms a colorable basis for recusal.

You know, except for the son working for the bank that loaned trump money after no US bank would. The bank under investigation for funneling Russian money through it. Then, suddenly deciding the Muslim ban was okay, the day before retiring. Pesky facts like that.

I think the personal relationship is far too convoluted to warrant reversal. I also believe that partisanship is a more straightforward explanation for his votes in Bush v. Gore, NFID v. Sebelius, and Trump v. Hawaii.

I'm willing to go with you on the personal relationship, unless the problems the bank that are being investigated turn out to be even more filled with corruption than we already know they are being investigated for. I appreciate you sharing your view.

Based on this rant, I don’t think you have. Although, I do imagine you’ll pretend you have, and that members of the public upset about the ties between Kennedy and Trump are ‘unreasonable.’ Good lord.

I'm not a lawyer; I'm a law librarian, and I have researched codes of judicial conduct on numerous occasions for law professors. This relationship would not have passed a conflicts check in a Philadelphia PI firm, let alone SCOTUS.

I was involved in a business case last year where the presiding Judge was personal friends with one of our attorney's mother. The Judge recused herself from the case. Conflicts are real and the appearance of a conflict are just as real.
