No, Kennedy’s relationships with the Trumps and Kushners warrant a deeper look before this conclusion can be drawn with any confidence. Justices have personal interests that can shape how they view the law and the Court. Enough of a connection will threaten the Court’s integrity.

However, we worry about “the appearance of impropriety” among judges for very good reasons, and several Justices have not been careful about avoiding this in recent years. This line of criticism really annoys me. He’s 81. He’s been on the bench since 1975 and a Supreme Court justice for 30 years. He owes no one a thing and has the right to retire and enjoy his last years of life.
