Rick Hasen Retweeted Vote November 6th  🌊

This tweet intimates that Justice Kennedy voted corruptly in cases because of his son’s work w Trump. That’s a very serious charge without evidence. Now the @adamliptak @maggieNYT “buttering up guy w huge ego to get him to leave” theory much more plausible.https://twitter.com/neeratanden/status/1012665534297624577 …

      Rick Hasen added,

      Vote November 6th  🌊Verified account @neeratanden
Just to state this: Justice Kennedy's son gave a billion dollar loan to Trump when no one would give him a dime, and Justice Kennedy has been ruling in favor of the Trump Administration position for 2 years as the Court decides 5-4 case after 5-4 case.

The connection between J Kennedy’s son and Trump has been long reported.https://www.politico.com/story/2017/04/donald-trump-supreme-court-236925 …

I’m as critical of Kennedy’s votes as many (and have another very critical piece out Monday @slate) but there’s nothing to suggest Justice Kennedy did his job with anything but the utmost integrity.

I make the same point about Justice Scalia in my book. One can think his jurisprudence unsound and even dangerous without impugning his integrity.https://www.amazon.com/Justice-Contradictions-Antonin-Politics-Disruption/dp/0300228643/ref=sr_1_1?ie=UTF8&qid=1516904231&sr=8-1&keywords=richard+l.+hasen …

So why did Kennedy retire when he did? He’s nearly 82, wanted to go last year but stayed another year likely because of Trump instability, and as I wrote @slate the day before Kennedy announced, he appeared out of gashttps://www.google.com/amp/s/amp.slate.com/news-and-politics/2018/06/did-justice-anthony-kennedy-just-signal-his-retirement.html …

This is not news people: "Last year, the Financial Times reported that Kennedy’s son was “one of Mr Trump’s most trusted associates over a 12-year spell at Deutsche.” https://newrepublic.com/minutes/149496/trumps-relationship-justice-kennedy-sounds-shady-new-report …https://www.ft.com/content/8c6d9dca-882c-11e7-bf50-e1c239b45787 …

Seems to me that not recusing himself from any case involving Trump, given the billion dollar relationship between Kennedy’s son and Trump, is grounds for at least questioning his integrity.

You cannot say the same thing about Scalia after Bush v. Gore. There’s no way to whitewash: “Our consideration is limited to the present circumstances.” Political hack!

We could.... But you know how the right wing loves their conspiracies. Turnabout is always fair play. If Obama had these ties to Kagan or Sotomayor; the GOP would have lost their goddamn minds. You can be disappointed, but it wasn't the son of a leftist with ties to trump

Were there times when because of his son's ties to Deutsche Bank he should have recused himself and didn't?

What is your logic? Once the existence of relationship is established, it's irresponsible to inquire about what that relationship may have entailed? You can say confidently that no favors exchanged & no pressure brought to bear on either side?

After reading almost all of Scalia’s opinions and following his public statements for decades, I concluded that Scalia was an arrogant, angry, resentful, condescending, partisan prick. In other words, a perfect Trumpist!

it seems wild to discount the idea that having a dangerous & unsound jurisprudence might tell us something about the person's character, though.

It’s hard to take your argument at face value when you plug your book in your thread. Otherwise, I appreciate the scholarly attempt at rationalizing Kennedy’s timing of departure. Your only argument for now is that he was waiting because of DT instability. Not solid.

Your observations seem wise and correct. Can someone in the Kennedy/conservative/GOP camp provide an explanation or perspective on the curious circumstances?
