Kennedy has picked his 4 clerks for the 2018-2019 SC term. That seems to be a good indication, at least for modern SC justices, that he plans to remain on the SC for the upcoming judicial term. Because he had his chance to issue a big ruling and didn't take it, and if he didn't take it now when the opportunity was tailor-made, then he's not going to do it in the future. Which means he's on his way out. Why stay around, then? I think that's the reasoning.
