      I see this as more evidence of Kennedy leaving. This term has the feel of someone who has done all he is going to do.

          Idk, I think that Kennedy will probably stay and wait for a time when there is a GOP WH and Dem Senate (or vice versa) to guarantee a moderate, consensus pick. Truth is, Roberts would move the court incrementally to the right, but it wouldn’t be seismic.

          Prob true. But even if a Kavanaugh, for example, is confirmed to Kennedy’s seat it won’t be a “major seismic shift” to the right like so many are predicting. It will move it incrementally to the right and in many ways, to the left (Roberts is to the left of AMK on some issues)

          Abortion. Affirmative Action. Religious Liberty. Not trying to sound like an ass, but if you can’t see why Kennedy retiring is a big deal, then I don’t know what to say.

          Oh, and I certainly see AMK’s retirement as a big deal. But I don’t think Chief Justice Judicial Restraint is going to make a “seismic shift”- exactly my argument. Also, other justices (Roberts) will likely drift left over time. Same thing happened with AMK after SDO’C left court

          I'm still not sold of the whole drifting left part. I do think a lot of the future "conservative" outcomes would be more narrow though. On some issues, the court would be the same as it is now, but on the issues I care about, it would be much better.

          Kennedy has actually been pretty conservative this term lol. I really hope Trump doesn't pick Hardiman if there is a vacancy. I want a proven conservative.
