Read Leah's thread. I'd add that running Kozinski's sentimental remembrance of J. Reinhardt (and @thenlj breaking news about @concurringopin blog post) will help rehabilitate Kozinski and give him a chance for role in the public discourse. Next will be law school lectures, etc.https://twitter.com/LeahLitman/status/1007320049412202496 …

It is really hard to think about all of the women who have wondered, and are still wondering, whether it is safe for them to share (on a bigger scale) their own experiences of harassment. Many of them have concluded it is not, and with crap like this, I don't blame them.

        1. What is basis that this will rehabilitate Kozinski? The fact that he published in @concurringopin rather than HLR's In Memoriam (also out this week) suggests major institutions are still excluding him. 2. Can anyone retweeting @LeahLitman take a second to please acknowledge

that AK didn't just write some self-promotional piece purely as a means to an end, but that he wrote a really touching tribute to a judge respected and loved by many that has value as an end itself? One can abhor what AK has done and oppose his future professional endeavors while

        1. We’re proud that @HarvLRev didn’t publish that piece (whether shopped there or not), and of any institution that didn’t as well. And 2. Find somebody else to write a touching tribute. We are not here for SH apologia bc it’s a “unique” view or whatever.

I didn’t say (and don’t believe) HLR was wrong not to publish it. It is obviously acceptable to say “we don’t want to publish an abuser.” But publishing a piece that a) does not in any way apologize for/sympathize with AK for his behavior, b) does not legitimize him

professionally, and c) is about and honors someone else who is deserving of honor should ALSO be okay and not be recast as a betrayal of abuse victims. Hell, the stories would have been just as good if published with no name (and, frankly, that’s about how much import the author

of it should have since it’s about Judge Reinhardt and not the author). Your response (and the original thread) are premised on the idea that publishing it = honoring/embracing Judge Kozinski. Why? I understand in the context of an academic article, where you are spotlighting the

author and his or her thoughts. But this piece was essentially “man shares facts that help people mourn different man.” It is maddening that it has been recast by some as being about the author rather than the subject. Also who exactly do you think slowly forgives/accepts AK as a

result of this tribute? That premise seems utterly inconceivable. If some dean says “aw, that tribute in a fairly random only publication was nice, let’s let a known sexual harasser on campus to speak,” I will a) eat my hat, and b) show up and picket the speech next to the rest
