I'm almost never a fan of the concept of a "teaching moment" but given the elevation of the lack of empathy in the U.S. lately (as well as the effectiveness of any punishment for swearing had on me) perhaps having a Holocaust survivor talk to them might better serve humanity.

I would add that the parents of said students should also accompany their children to the talk with a Holocaust survivor.

Isn't the Nazi salute essentially hate speech? A gesture IS communication (speech). American sign language is speech. So is this. These kids need to be suspended.
-
There is no hate speech exemption to the first amendment.
-
School children are not protected by the 1st amendment to "say" whatever they want. Kids are suspended for less than this. For their clothes, use of cell phones, texting abt behaviors outside of school, etc. School has a zero tolerance policy abt other things & need to for this.
-
Tinker vs Des Moines says they do have 1st Amendment rights.
-
Unaware of this, but two points. I'm basing my "opinion" on the reality of what happens in schools every day. And, wearing an armband in protest isn't "hate speech." The Nazi salute is hate speech. Schools have LOTS of rules. Would student be permitted to wear swastika t-shirt?
-
As I understand it, hate speech is not *always* protected—it’s context-dependent. Students have a right to a “free appropriate public education”. If student speech has a damaging/disruptive effect on other students’ learning, I believe speech can be censored.
-
So, if a kid is posting swastikas online, it’s hard to make that argument. If the kid is wearing a swastika t-shirt in class, I’m almost positive the school is within their rights to censor.

Black girls in the US are sent home because of their hair and these guys are free to do as they please.
-
Yup. And girls of every race and skin color are sent home for weather-appropriate clothing that boys are allowed to wear.

My high school made us color through writing on a shirt that said “the pen is mightier than the sword” because pen and is were too close together, then banned the shirts.

Texas.

One of my friends took a Sharpie and wrote “censorship!” all over her shirt.
