I was honored to work with @kmele, @thomaschattwill, and @jasonintrator to write in the NYT against broad, vague laws designed to suppress CRT. They’re speech codes and thus “antithetical to educating students in the culture of American free expression.”https://www.nytimes.com/2021/07/05/opinion/anti-critical-race-theory-laws-are-un-american.html …

      • Public education is a state monopoly, not a marketplace of ideas. • Voters, thru state legislatures, determine the curriculum. • Children should be protected from racial scapegoating. • "File a federal lawsuit" puts the onus on parents, rather than schools, which is unjust.

I still think this is a tactical mistake. CRT/I is indeed evil stuff, but this amounts to "If I were the education czar, things would be better." The true solution is to break the state's monopoly on public education, and encourage private schools to replace them.

I don’t think any of the four authors are coming from a bad place. I think they all oppose CRT. But they are awfully wrong in suggesting this is censorship of ideas. It’s making sure a state monopoly cannot indoctrinate kids with a racist ideology.

Voters are also entitled to honest discussion of what ideas are which, rather than misrepresenting them and then glomming onto that chimera any other ideas one dislikes that the whole might be taken for a 'toxic brand'.

          - good laws are specific. - state schools are monopolistic. Both true. I'm currently reading the Federalist Papers. Hamilton writes frequently about restraining certain realities of human nature. What are the ways the states dominion could be restrained in K-12?

Your first point buttresses French's. Our public schools cannot suppress speech. Nor, ofcourse, can private ones.
