They're not teaching it contextually; they're compelling students to accept it as dogma. The state bills simply say: "you can't indoctrinate students into neo-Marxist ideology." Legislators have a duty to make sure education reflects the values of their constituents.
It's not a "free speech" question; it's a "compelled speech" question. Free speech was not designed to protect the state; it was designed to protect citizens. The democratic legislatures have the right (and the duty) to shape the speech of the state in pursuit of common values.
