Only partly. He's right about the first part, that the Constitution didn't grant rights, it protected them, by entrenching in law what already existed. Rights are intrinsic to your existence as a human individual, whether that existence is derived from God or not.

And the concept of humanity -- individual human existence -- is even more universal and consistent (read: eternal) than the many conflicting concepts of God, held by various denominations and peoples in this world. And it doesn't exclude anyone of any other religion.
