Another way to look at it is the 12 Step concept of a "God as we understand him". That *sounds* like some sort of Christian god, at least to many, but it really means "not me". Politically it means "not some group of humans who assume the power to define rights".

yep the idea that ethcis must derive from some objective morality ( wich is deduced from objective reality) is taken as god granted bay many philosophers... but he puts out very porrly like advocating for a tehocracy or something like th divine right of kings

The problem is we're reading it today. The idea of God was stronger then than it is now. I agree that the founders were thinking more of Spinoza's God than Yahweh but that adds to the problem; people sticking to the letter and not the spirit.

Better to stick with Laplace and say "I had no need of that hypothesis" Argue that these rights are universal and when people have had the time to think about liberty they came up with similar thoughts and ideas. Each iteration refining the previous.

I think you’re giving Rubin too much credit in that explanation of god. He uses that word in the classic way, not the way you are interpreting, which is far more nuanced and carries way, way less unnecessary baggage.
