Ex 1: @amtrak doesn’t control the arbitrator, but it does choose the arbitration provider. And while arbitrators are required to “adhere to ethical rules,” they do not have to follow the law and precedent like a judge is required to do. /2/
Ex 2: According to @EPI, “Consumers obtain relief regarding their claims in only 9 percent of disputes” in arbitration. This statistic hardly squares with @amtrak’s assertion that arbitration “claimants win more often than they lose…” https://www.epi.org/files/pdf/132669.pdf … /end/
