    Kevin Strickland is innocent. Prosecutors say so. Judges say so. But because Strickland has exhausted his appeals, only AG has the power to release him. And because Schmitt refuses to do so, Strickland couldn’t attend his mother’s funeral.

    A great example of this is Pottawattamie County v. McGhee. Case likely would have carved out an exception to absolute immunity from civil liability when prosecutors fabricate evidence. Went all the way to SCOTUS. Settled at the last minute when it was clear they’d lose.

    For those who've never experienced it, let me just quickly descrsibe "strategic case mooting." Simply put, it's when the govt enforces a particular policy right up until they think a court might strike it down in a particular case, /1

    An Alabama man is on track to be executed, even though his civil rights claims have never been heard in federal court. Why? His filing apparently fell behind a cabinet in the court clerk's office. The Alabama AG says AEDPA doesn't care. The courts agree.
