What he did was horrific. He violated many laws, both American & Jewish, regarding the treatment of workers, theft, fraud, etc. He deserves to be punished.

The commutation of his sentence is a cynical move meant to kiss up to the Jewish community (a small part of it) & to reinforce that this administration is anti-immigrant, anti-worker.

And there are thousands of people in prison for far less serious crimes (or even violations that shouldn't be crimes) who deserve to have their sentences commuted much more than Rubashkin.

At the same time, I don't believe that prison is almost ever an appropriate or useful mode of punishment. It doesn't accomplish what punishment is supposed to accomplish, which is teshuvah/return to one's best self.

That's why prison isn't a part of classical Jewish criminal law (except in very restricted circumstances). It's mostly thought of as a non-Jewish form of punishment. Remember that first person to go to prison was Joseph, under Pharaoh.

And it's why return from prison is one of the times one bentsches gomel (prayer of thanksgiving for healing)--not assumed that one will return alive from (non-Jewish prison).

One of my favorite teshuvot by R'Hayim David HaLevy (former Sephardi chief rabbi of Tel Aviv) concerns his opposition to prison. (those who know me know that I have many favorite teshuvot of his. . . this is near the top)

He says: By all opinions, punishment is not a goal unto itself. Rather, it is intended to return the criminal to doing right. . . experience proves that imprisonment does not rehabilitate the criminal.

What would more appropriate punishment for Rubashkin be? Maybe many long years of working hardest job at his factory. Doing crap work for a workers' rights or immigrants' rights org. (taking suggestions for other punishments that would push him toward teshuva).

We shouldn't be celebrating that he's out, because it's a win for anti-immigrant & anti-worker forces. And because there's no reason to think that he's done teshuva or that other factory owners will now act differently.

AND calls for him to go back to prison for decades are both un-Jewish and counterproductive. We should be working hard to create better systems of punishment for ALL people that restrict prison to most dangerous, focus on restorative justice & teshuva for most (end of sermon)
