Ron:
1: His name is Akiva Cohen. You know that.
2: Her name is Kathryn Tewson. You know that.
3: She is *nobody's* "girl."
4: Referring to her as such simply because she knows the law around that complaint better than you do is petty and contemptible.
Then her boss Shapiro - whom I’ve had on mute for years because he’s such a pain in the ass - rides in to support his girl who he claims to think I’m gratuitously trashing.
Wrong. I have every right and arguably an obligation to my client to do respond. “Lawyer heat” ya know?
This case is the first one I have seen where *all* parties are doing the best that they can torpedo their own case or defense with their public statements
So, umm, yeah. I'm still feeling OK about my assessment that they didn't plead facts to support the claim that TI has taken place, since - provided Ron is telling the truth to the people watching the video - it looks like they currently know of no facts to support that claim.
by saying "now, that does not mean that I'd not be able to prove other damages that have happened that we're not aware of." And then there's some word salad and a pitch for the case to be "adequately funded."
Getting an injunction to stop TI that has not taken place is...ummm...I don't know how you show likelihood of success on the merits of winning a claim that isn't ripe.
Now, to be fair, Ron continues...
Ron *LITERALLY* says, referring to the TI claim against Bouzy, "that's one reason I can justify something that's a cause of action for something that, as of the time I filed it, has not happened."
(The "that's" is referring to getting an injunction to stop the attempt.)

Oh Lordy, there are tapes!
Ron went on a livestream and discussed this complaint.
Discussion of the fourth count starts here, at the 2 and a half hour mark.

Then again, maybe I'm underestimating things. I mean, if you're prone to using the phrase "little paralegal thoughts" in public, I probably shouldn't be surprised if you've seen lots of paralegals leave.
What exactly did she think was going to happen when she subtweeted her little paralegal thoughts about how incompetent a lawyer she’s never interacted with is?
How often, Ron, does a paralegal actually leave the practice before you do? This is - what? Partner at six firms in 15 years?
Are you perchance attempting to pokedex NY-area firms? Gotta partner them all?
FWIW, if a paralegal publicly identified (as I later learned) as working in *my* practice went on social media and started trashing lawyers about their work, she’d be out the door.
Shapiro should have *apologized to me* - but instead he attacked me with everything he has:
Aloha, everyone -
The Litigation Disaster Tourism Hour starts at 15:00 HST/20:00 CDT. We'll talk about the Bouzy/Nate Disaster Suit - and what not to do on social media when you're being sued. We'll also touch on Twitter changes.
I'm struggling to understand the logic as to how this plan does literally anything to stop spam and scams. But, here's the best I can come up with (note: it won't work) based on Musk's random musings... (1 of x)
Doing a CLE today - yet another "you need to fear, loathe, and avoid social media" video that's heavy on statistics, light on realism.
I gotta figure out how to get set up to do CLEs.
The banks that lent Elon money to take over Twitter are admitting that they're in for a "huge" haircut https://ft.com/content/d1879d0c-c52e-4f48-82f0-09458add4aee…
This is a good illustration of something that the interactive entertainment industry knows very well: the extent to which the complaints about "wokeness" and "bias" and so on come from people who are not customers, and have no intention of becoming customers.
You will also get:
- Priority in replies, mentions & search, which is essential to defeat spam/scam
- Ability to post long video & audio
- Half as many ads
But it's entirely plausible that the case makes it to the summary judgment stage - and Bouzy might just create a jury question yet.
And if he does, he better hang on - because, frankly, from everything I've seen Nate is likely to be seen as the more appealing person.
I cannot say that Bouzy has been shooting himself in the foot - his aim is too high and too midline for that.
And, in all seriousness, the defamation case against him is still not strong, particularly with regard to Nate's remarks about cops and evidence.
is currently doing everything in his power to snatch defeat from the jaws of victory. In fact, my view of the likelihood that he will lose the case has changed since reading the complaint - almost entirely because of Bouzy's own subsequent conduct.
I felt this was up there with the poll on what not to post when you're being sued. Rather or not you believe you think the case has merit or not. Thoughts?

I'm serious on that last bit. India's internet penetration has been growing, and continues to grow, but there are only about 25M Twitter users - and they're on track to hit 900M internet users in the next several years.
100M MAGA? Even if real, that's trivial in comparison.
Twitter has ~400M users. More of those users are in the USA than in any other single nation - but the ~78M American users are only about 20% of the total.
A sane growth strategy isn't "how many new MAGA users did we get yesterday." It's "how many new users did we get in India."
Replying to @Danielsand@PaulbernalUKand@questauthority
I think he’s betting on real free speech with a fair & balanced moderation will act as a huge draw.
MAGA = 100 million Americans dude.
So far, I’m not aware of anyone with a large following leaving.
Lots of threats, no action yet.
If you want to know why today's GOP is so unrecognizable to people who have been following American politics since the 80s and 90s, compare mainstream Republicans' crazed response to the Paul Pelosi attack with their sober, sympathetic response to the death of Vince Foster.
Right-wing-nut-jobs don’t just want a place where they can rant, abuse and say whatever words they want. If they did, they’d be quite content with Gab, Parler, Truth Social, some bits of 4Chan, Reddit etc. See, they’ve got plenty of spaces. 5/10
What percentage of the content here comes from the top 10% of active users? What percentage of ad revenues does that drive? And how many of us do you think are addicted enough to pay instead of either leaving or changing our habits?
If it's an ad expense, you're incentivizing me to stop looking at this as fun, and to join the ranks of those who use twitter to try to drive engagement to other platforms - the ones I can monetize. Why wouldn't I?
And I'm a rock-bottom tier creator (on my best day).
Elon, let me see if I can put it this way:
I'm a bottom-tier, barely more than a hobby content creator. Twitter is fun, but it doesn't pay. Most of my content is here, because this is fun, easy to use, and free.
If it's not free, I might stay, but it will be an ad expense.
