I would say the behavior made is irrelevant until applied somewhere, so the person making that decision is responsible
I'm just gonna write a program which sorts black people from white people, it's nothing to do with me who uses it or what for

I suppose I was thinking more in abstract terms. I definitely think whoever wrote the learning algorithm for that would be responsible.
