          There is no law against advertising a random process and then delivering it. What prevents companies from doing this is that people don't like it.

          Basically there was the consumer pressure to have a fixed price and there was a bigger consumer pressure to not have gambling vending machines. So in the end the fixed price lost. I don't see what regulation has been done here.
