This seems to me to be by far the most extreme statement made, such that I'm wondering whether I might be misinterpreting it or whether Philbin misspoke—because he is a much more careful lawyer than Dershowitz.

I take it back, he's doubling down on it now. Philbin, I think, is making a slightly different argument than Dersh. It sounds like a walkback but it is still very expansive.

Philbin's argument is that—if there is no underlying crime being charged—presidential motive just doesn't matter. That would seem to take you ... very far.
