In fact, SCOTUS ruled (albeit incompletely) in favor of unfettered broadcast speech in 2012: https://mobile.nytimes.com/2012/06/22/business/media/justices-reject-indecency-fines-on-narrow-grounds.html … While the FCC maintains these standards on their site for political reasons, they have no authority to enforce them. Any attempt to do so would likely fail.
