I'm not sure about the legalities in hiring. #1A might only apply once a faculty member is hired. And many American universities now demand right in the faculty job ads that applicants should 'demonstrate a commitment to diversity, equity, and inclusion'

How do you square that with the fact that the prof is an employee? I'm an employer. While I'm paying you, you operate within the parameters that I set. I don't see how it's a 1A issue. It would be 1A if the prof were investigated for comments made not in a teaching capacity.
