It's a gray area. Congress has a general power to "regulate commerce..among the states", so anything produced in one state and sold in another can be federally regulated. For intra-state activities, Congress's power is very weak. States themselves can regulate basically anything.
If the 'commerce clause' allows unlimited federal regulation of everything that happens between states, including all traffic in goods, services, data, speech, and ideas, what rights exactly would Americans have left?
Plenty. The 1st Amendment, of course, protects against gov't regulation of speech and ideas. The rest of the Amendments protect our guns #2A, our data (4A), etc. Goods & Services can be regulated, but only as much as a majority in the Senate & House will allow.
