PS the Constitution doesn't constrain gov't power all by itself. We have to actually _use_ the Constitution once in a while.

It's a gray area. Congress has a general power to "regulate commerce..among the states", so anything produced in one state and sold in another can be federally regulated. For intra-state activities, Congress's power is very weak. States themselves can regulate basically anything.
-
If the 'commerce clause' allows unlimited federal regulation of everything that happens between states, including all traffic in goods, services, data, speech, and ideas, what rights exactly would Americans have left?

Notes on the State of Virginia, Jefferson argues for religious liberty on the same grounds as we have liberty to decide what medicine to take or food to eat: "Was the government to prescribe to us our medicine and diet, our bodies would be in such keeping as our souls are now."

The power the government has to control this is highway money. States love money.

And yet we've had an unconstitutional federal War on (Some) Drugs for decades.

Not that that's stopped anybody actually in government.

The Constitution doesn't grant the FedGov the power to create an enormous unelected bureaucracy to "regulate" everything, unconstitutionally delegating Congress's lawmaking power. Wickard v. Filburn happened anyway. After decades of FDR eventually replaced the SCOTUS to get it.
-
A regulation is just a law that Congress didn't have the eggs to pass (because they'd lose their seats for voting in favor of), but is still binding on you and you can still be punished for disobeying.
