Was he speaking in context of nonviolent drug offenses? If so I imagine applying this "gaffe" to say he was speaking of things like mortgage fraud is a stretch
If he wants to legalize or decriminalize drugs, he should just say so.
And white collar criminals would actually be significantly deterred by jail time too, that scares the hell out of them. Paying a fine is just a calculated financial risk of the type that business people make all the time.
