The constitution limits the power of the federal government and all other matters of governance are then delegates to the states. So states should make harmful activities like wrechless driving and harmful drugs illegal.

Nothing about being able to outlaw an herb, either. Maybe that's why marijuana was not outlawed (at the Federal level), but merely taxed. They had SOME sense of shame back then. Well, you aren't allowed to pay the tax, so it is therefore always in arrears...
