I'm not sure how directly voters can affect campus culture, unless you are referring to the power of voters to shut down public universities. If so, isn't invoking the threat of the latter a bad thing for academic freedom in many other, more important ways?

Just remember, public universities ARE the government, for #1A purposes. This is just the executive branch making sure the 'academic branch' of gov't actually obeys the constitution. Kinda like the GAO making sure Pentagon procurement procedures follow federal laws.
