Argument shoots itseld in foot when he admits they use background/family background in assessment. And the consistent low score on 'personality' which is subjective and intangible compared to consistently high score on more objective (though still problematic) academic tests.

Interesting thread, and well argued. Still, every trial attorney in the country would prefer to represent the plaintiffs. Given this will be decided in a courtroom, not in seminar room or editorial meeting, Harvard is going to lose. Badly.

This controversy is easily solved if Chinese Americans start claiming they "feel White (or Afro or Hispanic) inside", a solution I'm sure will work as long as Harvard doesn't start checking closely where applicant's ancestors came from.
