Since there were POLICY decisions that deprived blacks of property, wealth, and equal rights, all of those decisions were, in fact, a VIOLATION of the 14th amendment (which might be worth revisiting)

It is this violation of the 14th amendment that the government is on the hook for. Just as we would expect recompense from a corporation that stole the land of a citizen, so the government must take responsibility for policies that violated the rights of its citizens.
