Well, if your patents require the opponents to spend billions even to replicate your results, then it easy to play it this way. If you are a small software company and the competition is huge and everyone steals (reverse engineered) code from each other, you don't have a choice!
Software patents don’t matter, because they’re unenforceable. Ask any VC how much they value a software startup’s patents.

I am afraid that they are more than enforcable given that you have a reverse engineering team that can actually detect the breach and a legal team that can present it in a court of law (and enough money for a bit of lobbying).

In the long run software patents have been proven quite useful tools for companies that can get over the initial funding issues and start growing their customer base beyond the initial supporters/stock holders.
