I would add a “solely” to this statement. If a reasonable third person witness can’t determine if a crime has occurred then we are at the witch dunking stage of equating accusation with guilt.
Any crime that depends on the subjective judgment of the accuser isn't (e.g., "unwanted touching").

Home invasion vs. neighborly visit posits a similar problem. The difference is consent, the question is under which conditions consent needs to be explicit vs. can be assumed to be implied. The norms when it's considered to be implied did often change within a generation.

Some interactions with people require affirmative consent. If I like punching people, I can find someone else who likes it too, and we can arrange a boxing match and have fun. But if I start punching a random person on the street, it is "unwanted punching" (aka "assault"). ...

... I cannot just say "Hey, I thought he liked it. It was fun for me. He punched me back, so I assumed it was fun for him too. If he doesn't like it, why didn't he just say so? Why did he engage?"
