Before you take money from an investor, ask them if they've ever threatened to sue one of their portfolio companies.

Ask them, or ask someone else? Or both? (Also, in large VC firms, would every partner necessarily know about years-old lawsuits?)

Both ideally. YC founders can of course ask YC. Because they fund so many cos, YC knows more about other investors than anyone.

You could ask for more details, but in my (extensive) experience of these cases, the investors are almost always in the wrong.

will they tell? Or should founder research by own?

I'm not sure, but if they lie they have to worry you'll find out by talking to the founders they threatened.

It is easy for early stage to judge investors who thought they had some downside protection when seed investors expect many zeroes.

Isn't this a function of stage? Seed stage shouldn't, as fraud = wrong founder bet. But a growth fund who was defrauded is different.

Still seems like great advice though, as I am overly concerned with theoretical corner cases.

I think those that threatened may not answer truthfully - better vetting can be done by speaking with founders they funded who failed

Threaten to sue so they can strong arm founder or sue due to neglect/deficiency by founder. I am guessing u r alluding to former.
