I see nothing precluding dealing with emergencies. But let’s get real, vast majority of work email outside of work isn’t emergency.

“emergency” is loosely defined. The onus is still on the business to plan for disaster. Out of hours contracts etc.

the law require only enterprise to put rules on this topic. For example you can say SMS should be use for emergencies.
