Without the death penalty, why wouldn't someone who has committed a life-sentence crime attempt to murder credible witnesses?
That doesn't seem to be a problem in the 23 states that don't have the death penalty.

The death penalty is so rare and then rarely executed (15% convicted are executed), it's not material enough to deter anywhere. There are costs and benefits to the death penalty, and in high-crime countries the benefits are significant. Just saying zero is not obviously optimal.
