For the sake of argument, who would be immune to abuse of power? I agree it’s a problem, but less government isn’t necessarily a solution. I suspect getting rid of private prisons would help cases like this one.

This is cruel and unusual punishment: excessive, arbitrary, serving no legitimate purpose, repugnant to normal society. Should it be upheld, it allows the state to ramp up penalties by merely “forgetting” to follow their own procedures. Here’s hoping SCOTUS does the right thing
