While the laws are often dumb, we have a great system built up for applying/interpreting them, with specialist judges, body of precedent, and an appeals system. In the meatspace, the judicial system is designed to judge by a system of "reasonable" peers - translated to crypto it seems those peers could simply be active via on-chain governance. Wisdom of the crowd could help smooth out any outliers due to larger sampling size of peers

Precedent can still be set, but most importantly, it can easily be over turned so that you don't end up with stupid laws such as not being able to wear red pants on Sundays while playing clarinet. The compounding effect of law by precedent is a slippery slope
