Ah but in this case, TWiT are arguing the letter and email correspondence constituted the agreement (which is perfectly valid). There appears to have been no formal written agreement. Broader point is “If you can’t get a full agreement, at least get it in writing”!

Yep, contracts are mostly for when things go wrong. When everything is going to plan, no one cares about contracts. When sh*t hits the fan and nobody is your friend anymore, does it still work for you? That should be the basis of signing a contract.
