"X was in technical non-compliance" is one of those things that I find difficult to evaluate, because it is likely true of every X in set Y.

Part of working in a regulated industry is knowing which of the regulations are fudgeable and which are not. Part is pretending you don't.

You can make some pointed social commentary about who gets caught for non-compliance when everyone is in constant state of non-compliance.
