Lately, I've been spending a lot of time in caregiver support groups on Facebook, helping members like Mary (below) and here's the thing: Caregiving is so complex. We think and talk about it as a medical role – but that's only a small part of what family caregivers actually do.pic.twitter.com/fxfL3K5Yl7

Not a lawyer but am very, very experienced with the following bit of advice: any call with creditors should include a pre-emptory statement like “It is inconvenient for me to receive calls at this number or any other. I will deal with you exclusively over postal mail.”

This sets in motion a state machine with the Fair Debt Collection Practices Act (FDCPA), which one can cite by name if one wants.

I’ve ghostwritten a few dozen letters for folks in similar circumstances to your correspondent. Thanks for helping them; procedural nuances aside, polite but firm refusal to engage is instrumentally probably the correct play, like you suggested.

Noted! How’d you figure that out? Haven’t seen it in any online guides or heard it from the attorneys I spoke to on my mom’s behalf. (Admittedly, I haven’t read that piece of legislation verbatim, in case that’s the answer...)

Worth mentioning that I do my best to keep the advice I give as simple as possible while still being thorough, since people are often in really far over their heads. (I’m reminded pretty often that most people are super uncomfortable with even talking to an attorney!)

But I’m also engaging with these groups as a way to learn more about what kind of help caregivers want or need most. So – for me, at least – gathering obscure knowledge about relatively common caregiving-adjacent topics is the point!

How I came upon it is a long story; I ended up with $100k+ of debt on my credit reports, went down a rabbit hole about learning about consumer protection laws, joined a forum with other people dealing with adjacent issues, and (because weird hobbies) started ghostwriting letters.

Here’s the cite for you: https://www.ftc.gov/enforcement/rules/rulemaking-regulatory-reform-proceedings/fair-debt-collection-practices-act-text#805 … A debt collector may not communicate with a consumer in connection with collection of a debt... a time or place known or which should be known to be inconvenient to the consumer.

That is obviously super broad, so one’s opening play is generally forbidding them from any communication but postal mail, which debt collectors find less advantageous to pursue and which more quickly collects a paper trail that you can use if you need to escalate.

n.b. First party creditors are not debt collectors under the FDCPA but many states have similar restrictions on them, too, and there is no downside to the consumer for leading with the declaration of inconvenience.
