I’ve gotten a few cranky replies pointing to the admissions clause in the Constitution (Art. IV, Sec 3) as a rejoinder. Yes, obviously, but they had no concept of an “Indiana,” which didn’t even become a territory until 1800.

And I’ve responded a few times that the powers Congress has used to enlarge the federal government are just as latent in the Constitution and its amendments as creating new states.

Nay! some have replied. Creating new states is clearly spelled out! Having a national public health agency is not! Well, you know what else the Founders didn’t intend? For the courts to have judicial review to tell Congress what it couldn’t do.

John Marshall found a politically clever way to assert judicial review into his 1803 Marbury v. Madison decision in a way he rightly believed would not get challenged (those in power got what they wanted). It wasn’t used again until the 1857 Dred Scott decision.

The Founders expected Congress, as the representatives of the sovereign people, to interpret the Constitution. They trusted future generations to do so. So should you.
