On a case, you have all of your constitutional rights, including the right to a jury trial. Anyone want to do jury duty in a pandemic? On parole, you just get a hearing, everyone gets violated. Most people admit a violation for a set period of incarceration. /3

On a parole violation the standard is preponderance of evidence or more likely than not, anything greater than 50%. For a criminal case, you need to be able to prove the case beyond a reasonable doubt to 12 jurors. Highest burden in our justice system. /4

For these reasons and more, letting parole handle low-level offenses is standard procedure. It's a question of resources and efficiency, which all DAs have to consider. This isn't a Chesa thing, this is a criminal system thing, even in the most extreme pro-trump counties. /5

Finally, eff those who are using the death of these two women to advance their sad agenda. Trump lost, you lost, get lost. /fin

Thank you for this thread, seriously. I just stuck my neck out for the first time on Twitter in anger over Chesa's authoritarian haters. I got brigaded - it's by far my most popular tweet, and everyone is implying I'm inhuman for suggesting that we can't lock everyone up forever.

Idk if you'll see this but I appreciate your thread b/c it makes a solid argument (better than I did, I think) and it calls out people who support continued over-incarceration for who they are: Trump-like authoritarians.

SF is not lawless, Chesa is throwing the book at this guy. Serious question: How do you think we will end "drug addiction" and "mental health neglect"? My answer is: not by denying probation (to those who present low risk) or by locking everyone up.https://sfist.com/2021/01/01/two-women-killed-in-soma-hit-and-run-suspect-identified-as-parolee/ …

But how is all this stuff low level?

Nobody is saying serious crimes like this one should go unprosecuted. I am trying to argue that alternatives to incarceration for low level crimes are a good policy that leads to a safer community. It can work.

It could perhaps work, but this isn’t a good track record. These two people lost all they had, seemingly on account of an experiment.
Before experimenting, It may be good to ensure that @chesaboudin understands 100% what is low level and what is not.

And I’m not sure I agree with the part that “no one is saying...” The issue here is that
@chesaboudin seemingly is saying the opposite.0 replies 0 retweets 0 likesThanks. Twitter will use this to make your timeline better. UndoUndo
