IANAL, but what seems interesting to me is the fact that feeding code into an algorithm doesn't trigger the GPL (r-o). Shipping some NN weights also doesn't, since it isn't code in any shape or form. The ones risking getting into trouble might be Copilot users themselves.
Which, to me, raises the Q: Who would be responsible, MS or the Copilot user? If there was an automated tool to check if a piece of code infringes copyright, it could be used alongside Copilot. But is that even possible, considering you can infringe w/o doing a verbatim copy?

meh this rationale hinges on the idea that you can build a machine-learnt model from corpus A but it's not a derivative of said corpus which implies that you could exchange the corpus and obtain the same model, if the model isn't derivative from the corpus except you cannot
