Sharing the syllabus for a movement lawyering course I've taught for the past few years. It continues to evolve and change, but I've found it effective in building classroom culture and exploring major aspects of lawyering with social movements. Thread/

Good decision from the WA Supreme Court. Fines and fees always disparately punish those without wealth.

New from me: AEDPA instructs the federal courts to trust the states when it comes to preventing and correcting wrongful convictions. But reformist prosecutors have revealed more evidence that state systems don’t deserve that sort of deference

Abridged draft for congress: 1) No private party or public entity may institute process for, or execute, an eviction from a home, dwelling, residence, or other living space; 2) No court shall have jurisdiction to hear challenges to this section or brought under this section.

Something that hasn't happened in a while just happened. Car drove by me and person inside randomly flipped me off. Made me homesick for Boston

One interesting note is that the challenge here is based on similar theories used by abolitionist lawyers who were challenging state's participation in federal fugitive slave laws.

Plymouth is the biggest county in MA with a remaining agreement. Bristol's was terminated after findings of systemic abuse in the Bristol facility (and on heels the mass release of individuals pursuant to Savino v. Souza, also litigated by , and )

The case was brought by and on behalf of 28 taxpayers in the Commonwealth of MA who are challenging the ability of MA sheriffs to enter into 287(g) agreements.

UPDATE on 287(g) agreements in MA: The Superior Court has allowed our case challenging the PCSO's 287(g) agreement to move forward! The decision casts serious doubt on the legality of these agreements in MA in light of the narrow powers of sheriffs and prior SJC precedent.

These are all lawyers who know this, but most galling is that there are lawyers on here who have acted as government attorneys. This means that their knowledge is not abstract. They have in fact made arguments that courts have no jurisdiction over prison/imm cases. 6/End

So when these practitioners "oppose jurisdiction stripping" what they mean is that they are fine with it for prisoners and immigrant and don't want it to apply to other classes of cases (e.g. challenges to a VRA or GND). 5/

For prisons there are almost too many things preventing access to court to list. This includes the PLRA and AEDPA. 4/

Let's look at some immigration statutes. 1252 and 1254a both have jurisdiction stripping provisions that attempt to make it impossible for immigrants to seek relief in court for violations of those statutes/challenges to those statutes. 3/

I support jurisdiction stripping because I support lessening the power of the court. But, that aside, this report pretends that jurisdiction stripping does does not currently exist. It does, but primarily for 2 classes of people - people in prisons and immigrants. 2/

This whole submission is laughable. 1000 problems I could point out with their rejections of all major reform proposal, but as a lawyer working in prisons and detention centers, the jurisdiction stripping section is the worst. 1/Thread

Honestly, has the most amazing interns this summer. Floored every time by the quality of their work and the thoughtfulness they bring to representing folks inside jails and prisons.

They have been abused. As have millions of people in our criminal legal system. If you think this is wrong, and you should, then I welcome you to join the fight against prisons. (Although we're not at the same level as the war on terror abuses, but we need not be to oppose abuse)

We are pleased that the Tenth Circuit ruled on behalf of our client Charles Williams, whose religious practices were interfered with in a Colorado prison. The court vindicated the importance of Native American religious services to their practitioners.

When you see this elite journalist saying (contrary to the evidence) that “we’re going to need police to bring levels of violence back down,” think about who he means by “we” and what he means by “violence.”
