If they replaced the phone's (or some apps) default set of emoji with the facial pictures, without the expectation that anyone but that phone's user would see them as such, they could be considered emoji. This is an unlikely scenario though.

Well, emoji do predate their unicode code points, so there’s no reason that should be their defining characteristic
