Did you see that analysis someone did? The algorithm "works" by telling the difference between personal photos and mugshots
quoting the paper: "We stress that the criminal face images in Sc are normal ID photos not police mugshots."

however, looking at figure 1 I think it is pretty obvious what kind of biases the algorithm is learning.

e.g. all non-criminals in this figure wear clean white shirts. None of the criminals do.
