It feels like the right thing should be to reject both. No? (Even if LRM says different)

"test" is a driver-driver conflict and should produce at least a warning and there's no "right" value for "foo". But "test1" and "test2" are perfectly valid, have deterministic behavior, and should be supported if possible imo. However, nobody should write code like that. ;)
