Software patents are a bad idea because you should only be able to control your implementation, not the idea being implemented. API copyrights are a bad idea for the same reason.

Yeah, I don’t think we want that future. It would probably lead to insane secrecy within companies.
As opposed to what? It's not like they have their source code out in the open right now and for patents they usually keep enough "secret sauce" to make the patent as-is useless. (Besides the fact that a 20 year protection period for patents is just ridiculous nowadays imho.)
