Imagine how Kavanaugh would have ruled if he were the judge.
That's from a feferal district court. I'd expect Trump to fight this. Usually they can take something like this directly to SCOTUS, but if they go through a circuit court first, Kavanaugh will be long confirmed before this is in front of SCOTUS. (That is if he's confirmed.)
